Should obstruction be offered within the 20 years, a suit to recover the right of user must be instituted within 2 years after the last act of user. Glover, J.--The Judge has found as a fact that the plaintiff had no user of the water since 1275 B. S., and that he was therefore barred by section 27, Act IX. of 1871, the present suit not having been brought till 1278 B. S., or more than two years after. The special appellant contends that the suit could not be brought any lime within two years of the obstruction of the right of user by the defendant, and that the right to use the water of the tank was necessarily periodical, and not continuous.
